1. Agreement to Terms

By accessing or using the services provided by EasyStartup, operated by QOPTERVZN INFOCOM PRIVATE LIMITED ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use our services.

2. Services

EasyStartup provides professional website development services for businesses. Our services include website design, development, deployment, and post-launch support as specified in the selected package.

2.1 Service Packages

We offer fixed-price website packages with clearly defined scopes. The specific features, deliverables, and support periods for each package are outlined on our website and in the proposal provided before project commencement.

2.2 Custom Development

For custom development requirements beyond our standard packages, a detailed scope document will be provided for approval before development begins. Any changes to the approved scope may result in additional charges.

3. Client Responsibilities

To ensure timely delivery, the client agrees to:

  • Provide all necessary content, images, and information within the agreed timeline
  • Respond to communications and provide feedback within a reasonable time
  • Designate a single point of contact for project communications
  • Review and approve deliverables at each milestone
  • Ensure all provided content does not infringe on third-party intellectual property rights

Delays caused by the client in providing required materials may result in project timeline extensions.

4. Payment Terms

4.1 Pricing

All prices listed on our website are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without prior notice for new inquiries.

4.2 Payment Schedule

  • 50% advance payment is required before project commencement
  • 50% balance payment is due upon project completion and before final deployment
  • For custom projects, a mutually agreed payment milestone schedule will apply

4.3 Late Payments

Late payments may attract interest at 1.5% per month on the outstanding amount. We reserve the right to suspend services until all pending payments are received.

5. Intellectual Property

5.1 Client Ownership

Upon full payment, the client receives full ownership of the website design and custom code developed specifically for their project. The client is free to host, modify, and manage the website as they see fit.

5.2 Third-Party Components

The website may include third-party components (themes, plugins, libraries) that are subject to their respective licenses. These components remain governed by their original license terms.

5.3 Portfolio Rights

We reserve the right to display the completed website in our portfolio and marketing materials unless the client explicitly requests otherwise in writing before project completion.

6. Project Timeline

Estimated timelines are provided in good faith based on typical project scopes. Actual delivery times may vary depending on:

  • Timely provision of content and materials by the client
  • Complexity of requirements and feedback cycles
  • Third-party service dependencies (domain, hosting, APIs)
  • Force majeure events

7. Limitation of Liability

To the maximum extent permitted by applicable law, EasyStartup shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with the use of our services.

Our total liability for any claims arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

8. Warranty

We warrant that our services will be performed in a professional and workmanlike manner. We provide a post-launch support period as specified in your package to address any issues related to the agreed scope of work.

This warranty does not cover issues arising from:

  • Unauthorized modifications by the client or third parties
  • Third-party service outages or changes
  • Browser or device compatibility issues beyond reasonable testing scope
  • Content changes or additions beyond the original scope

9. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information shared during the course of the project. This includes business strategies, technical details, and financial information.

10. Termination

Either party may terminate this agreement with written notice if the other party materially breaches any obligation under these Terms and fails to cure such breach within 14 days of receiving notice.

In the event of termination by the client without cause, work completed up to the termination date shall be billed proportionally, and any advance payment shall be non-refundable for work already performed.

11. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from circumstances beyond their reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, or other force majeure events.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bhandara, Maharashtra, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on this page. Your continued use of our services after any changes constitutes acceptance of the new Terms.
